The Governor of Arizona has signed SB1350. This law strips away city and county ordinances against short term rentals of homes (less than 30 days). Typically these vacation homes were advertised on Airbnb, VRBO…etc. The law is expected to go into effect on August 5 2016.
It does not however affect Home Owner Association restrictions. If your HOA does not allow short term rentals they may continue to restrict them.
This is a big deal. The City of Sedona has been strictly enforcing ordinances against the short term rental of homes for quite awhile now. I’ve spoken to city officials and it appears they will be complying with the law and not fighting it. Yavapai County had a similar law on the books but was much less enthusiastic in it’s enforcement. The situation is fluid and subject to change. The law could be delayed or even eliminated in the courts. If it’s important to you, I’d advise to keep up on the latest news and it’s status.
If you’re interested in buying a vacation rental home, perhaps looking for a home that is not governed by an HOA or has restrictive CC&R’s (Covenants, Conditions, and Restrictions) would give you the best choice. Here’s a link to our “Sedona No HOA Homes Search“.
